Terms of Service

These terms are an agreement between you and Inbox Zero Inc. (“Inbox Zero,” “we,” or “us”) for your use of the Rakazo service that we host, the Rakazo web, desktop, and mobile apps, and rakazo.com (together, the “Service”). By using the Service, you agree to these terms. If you use the Service on behalf of an organization, you confirm that you can bind that organization to these terms, and “you” includes it.
Open-source software
The Rakazo source code is available under the Apache License 2.0. That license, not these terms, governs your use of the code. It does not grant rights to the Rakazo name or logo; do not use them in a way that suggests we operate or endorse something we do not. A third party that operates a self-hosted Rakazo deployment is responsible for that deployment and its own terms.
Your account
You must be at least 13 years old, and old enough to form a binding contract where you live, to use the Service. You may not use the Service if you are barred from doing so under US sanctions or export laws. Keep your sign-in details and connected credentials secure. You are responsible for activity in your account.
Bots and AI output
Bots act with the instructions, permissions, and connected accounts you give them, including when you are not watching, such as in scheduled routines. Actions your bots take, such as sending messages, changing data, making purchases, or running commands, are taken on your behalf and are your responsibility. Give bots only the access they need, and require approval for actions that are hard to undo.
AI output can be inaccurate or incomplete. Review it before you rely on it. Do not use the Service where an error could cause death, injury, or serious harm, or to make decisions with legal, medical, or financial consequences for others without qualified human review.
Acceptable use
You may not use the Service, or direct a bot, to:
- Break the law or infringe the rights of others.
- Send spam, distribute malware, or commit fraud.
- Access systems, accounts, or data you are not authorized to access.
- Interfere with the Service, circumvent its limits, or use its computers for cryptocurrency mining or attacks on other systems.
- Violate the terms of the model providers or connected apps you use through the Service.
- Create accounts by automated means or to evade limits, or resell or provide the hosted Service to others without our written permission.
Your content
You keep ownership of the content you provide and the output your bots produce, and you are responsible for having the rights to provide it. You give us permission to host, process, and transmit that content only as needed to provide the Service, as described in our privacy policy. We may use aggregated or de-identified usage data to operate and improve the Service. If you send us feedback, we may use it without obligation to you. Keep your own copies of content that matters to you.
Third-party services
The Service can connect to model providers, voice and memory services, computer providers, and other apps you choose. Those services are governed by their own terms, and we are not responsible for them. You are responsible for fees they charge you, including usage your bots incur on your own API keys.
Paid plans and billing
Some features require a paid plan. Prices are shown before you subscribe. Subscriptions renew automatically at the end of each billing period until you cancel, and we charge the payment method on file, which is processed by Stripe. Prices exclude taxes unless stated otherwise. If your plan starts with a free trial, we collect a payment method at signup and charge it when the trial ends unless you cancel before then. Cancelling during the trial ends it, and you are not charged. Plans may include usage limits, and we may slow or pause usage that exceeds them or places an unreasonable load on the Service. If a payment fails, we may pause paid features until it succeeds. If you dispute a charge with your bank instead of contacting us, we may suspend the account while the dispute is open. We will notify you before a price change takes effect on your next renewal, and you can cancel before it does.
Cancellation and refunds
You can cancel at any time from your account’s billing settings or by emailing hello@rakazo.com. Cancellation stops future renewals; you keep access until the end of the period you paid for. Payments are non-refundable and partial periods are not prorated, except where required by law. If you were charged in error, email us within 30 days and we will refund the charge.
If you are a consumer in the European Union or the United Kingdom, you can withdraw from a new subscription within 14 days of buying it by telling us, for example by email. Because you ask the Service to start immediately, we will refund your payment less an amount proportionate to the Service provided before you withdrew.
Changes to the Service
We may add, change, or remove features. Features marked as beta or preview may be incomplete or change without notice, and we do not promise the Service will be uninterrupted or error-free. If we materially reduce a paid feature during your billing period, we will tell you in advance, and you can cancel and receive a refund for the unused period.
Termination
You can stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these terms, do not pay, or put the Service or others at risk, or if the law requires it. Where reasonable, we will tell you first. If we terminate your account or stop offering the Service for reasons other than a violation of these terms, we will give you reasonable notice and refund any prepaid fees for the unused period.
When an account is deleted, its bots and routines stop and we delete its content as described in our privacy policy, so save anything you want to keep first. Terms that by their nature should survive termination, such as fees owed, disclaimers, limits of liability, and indemnity, continue to apply.
Disclaimers
TO THE EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR US$100.
Nothing in these terms limits liability that cannot be limited by law, such as for fraud, gross negligence, or death or personal injury caused by negligence, or rights you have as a consumer that cannot be waived.
Indemnity
To the extent permitted by law, you will compensate us for third-party claims, and reasonable related costs, arising from your content, your bots’ actions, or your violation of these terms or the law.
Changes
We may update these terms. For material changes, we will notify you before they take effect. If you do not agree, you can cancel before then. Continuing to use the Service after that means you accept the updated terms.
App stores
If you download a Rakazo app from an app store, that store’s terms also apply to the app. For the iOS app, Apple’s Standard EULA applies. Apple is not a party to these terms and is not responsible for the Service or its support.
Governing law
These terms are governed by the laws of the State of Delaware, without regard to its conflict of law rules. Disputes will be resolved in the state or federal courts located in Delaware, except where your local law gives you the right to bring a claim where you live. To the extent permitted by law, you and we each waive any right to a jury trial.
General
These terms, together with any terms shown when you buy a plan, are the entire agreement between you and us about the Service. If any part is unenforceable, the rest stays in effect. Not enforcing a term is not a waiver. You may not transfer these terms without our consent; we may transfer them in connection with a merger, acquisition, or sale of assets. Neither of us is responsible for delays caused by events beyond reasonable control. We may send you notices by email or in the Service, and you can send notices to us at the address below.
